This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue a writ order or direction more particularly, one in the nature of Writ of Mandamus declaring the action of the Respondents 2 to 4 in not granting DKT pattas for the land in Sy.No.24/1 and 24/2 to an extent of Ac.2-50 cents and Ac. 1-33 cents of Gopalapuram Village, Badvel Mandal, YSR Kadapa by considering our representations dated 05.01.2023, 09.02.2023, as illegal, arbitrary and violative of principles of natural justice consequently direct the respondents to mutate the names of the petitioners in the revenue records by issuing the DKT patta by considering our representations 05.01.2023, 09.02.2023 and pass” 2. Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for the respondents. 3. The learned counsel for the petitioners submits that the petitioners made applications/representations dated 05.01.2023 and 09.02.2023 to the respondent authorities, seeking issuance of DKT pattas in respect of land situated in Survey Nos.24/1 and 24/2, admeasuring Ac.2.50 cents and Ac.1.33 cents respectively, of Gopalapuram Village, Badvel Mandal, YSR Kadapa District. Despite receipt of the said representations, the respondent authorities have neither considered the same nor issued any proceedings till date. Hence, the present writ petition is filed. 4. The learned Government Pleader for Revenue appearing for the respondents readily agreed to consider the applications/representations dated 05.01.2023 and 09.02.2023 submitted by the petitioners, if the same are pending consideration before the authorities. 5. In view of the submission of the learned Government Pleader for Respondents, this Court need not decide the truth or otherwise of the allegations made in the petition. This Court is conscious that no such direction be issued, in view of the judgment of the Apex Court in “The Government of India v. P.Venkatesh1”, wherein the Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do no service to the cause of justice. As the learned counsel for the petitioners himself requested to issue a direction to consider the applications/representations dated 05.01.2023 and 09.02.2023 submitted by the petitioners, this Court find no other alternative except to issue such direction. 6. In the result, the writ petition is disposed of, directing the respondent authorities to consider the applications/representations dated 05.01.2023 and 09.02.2023 submitted by the petitioners and pass appropriate speaking orders within a period of three (03) months from the date of receipt of a copy of this order, after conducting field verification based on the relevant records and feasibility, and after providing an opportunity of 12019 (8) SCALE 544 hearing to the petitioners and other stakeholders, if any.
