AMARNATH GOUD ORDER 25.04.2025 Heard Mr. Somik Deb, learned Sr. counsel assisted by Ms. J. Mahama, learned counsel appearing for the petitioner. Also heard Mr. B. Majumder, learned Dy. SGI, appearing for the respondents-Union of India. [2] This present petition has been filed under Article 226 of the Constitution of India seeking the following reliefs:- (i) Issue RULE, calling upon the respondents and each one of them, to show cause as to why a writ of Certiorari and/of in the nature hereof, shall not be issued, for transmitting the records, lying with them, for rendering substantive and conscionable justice to the petitioner, and for quashing/setting aside the impugned Communication dated 07.08.2024 (Annexure-1 infra) insofar as the same grants lesser pay to the petitioner. in contrast to that of the proforma respondent, with effect from 01.07.2016; (ii) Issue Rule, calling upon the respondents and each one of them, to show cause as to why a Writ of Mandamus and/or in the nature thereof, shall not be issued, for mandating/directing them, to revoke/rescind the impugned Communication dated 07.08.2024 insofar as the same grants lesser pay to the petitioner, in contrast to that of the proforma respondent, with effect from 01.07.2016, and thereupon, forthwith fix the pay of the petitioner, at par with the proforma respondent, by way of stepping up of pay, with effect from the relevant date wherefrom the pay anomaly arose (01.07.2016), and thereupon, grant the arrears of pay, alongwith all the consequential benefits in connection therewith, including arrears thereof; (iii) After hearing the parties, be pleased to make the Rule absolute in terms of (i) to (ii) above; (iv) Costs of and incidental to this proceeding; (v) Any other Relief(s) as to this Hon'ble High Court may deem fit and proper;” [3] It is seen from the record that a proceeding dated 07.08.2024 was initiated by Deputy Inspector General (Administration) addressed to the Inspector General, Southern Sector, CRPF regarding discrepancy in salary of the petitioner. [4] In view of the above, without expressing any opinion on the merits of the case, this writ petition is disposed of directing the respondent No.3, to pass a reasoned order in the light of the proceeding dated 07.08.2024, as expeditiously as possible preferably within a period of 03(three) months from the date of receipt of the copy of this order in accordance with law. With the above observation and direction, this present writ petition stands disposed of. As a sequel, miscellaneous application(s), pending if any, shall stand closed.
