The reasons for delay has been explained in paragraph nos. 2 and 3. 3. It is submitted that the Appeal for enhancement by other Claimants arising out of the same project has already been enhanced by this Court. Respondent no. 2 though served, none appears for Respondent no. 2. 4. Considering the explanation for delay given in Application, the Civil Application is allowed on the condition that the Claimant shall 2 1059.odt give an undertaking to the Registrar (Judicial) that he shall not claim any statutory benefit and the interest for the delayed period in filing the Appeal.
