The petitioner claims that he is entitled to arrears of salary as per recommendation of 7th Pay Commission from July 2018 to June, 2023. A representation in this regard has been made but to no avail. Shri Subhranshu Shekhar, learned Additional Chief Standing Counsel on behalf of the respondent-State submits that the matter requires factual determination as per applicable law by the competent authority in the first instance. He, however, fairly contends that the issue regarding his arrears of salary as per recommendation of 7th Pay Commission has to be determined by the competent authority within a reasonable time frame. In wake of the preceding discussion and without going into the merits of the case, the respondent No.3-District Magistrate, Ghazipur is directed decide the representation of the petitioner regarding his arrears of salary as per recommendation of 7th Pay Commission from July 2018 to June, 2023 as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of representation. With the aforesaid directions, the writ petition is finally disposed of.
