(Accused Petitioner Is In Central Jail, Jaipur). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Amitabh Vijaywargiya For Respondent(s) : Mr. Manvednra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 24/01/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 615/2023 registered at Police Station Muhana, District Jaipur City (South) for the offence(s) under Sections 8/21 of NDPS Act.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. There is no evidence available on the record that petitioner was involved in supplying or receiving the contraband article. Contraband article recovered from the possession of other co-accused Pushpendra who has already been enlarged on bail by this court vide order dated 16.06.2023. Quantity recovered from the other co-accused is less than commercial quantity. The accused petitioner is in
[2025:RJ-JP:3538] (2 of 2) [CRLMB-1124/2025] custody since 10.01.2025 and the trial of the case will take considerable time. Therefore, the benefit of bail may be granted to the accused-petitioner. Per contra, learned Public Prosecutor opposes the bail application and contended that petitioner was found to be involved in similarly nature of two cases, therefore his bail application deserves to be dismissed. Heard and perused the material available on the record. Considering the fact that apart from the disclosure statement of other co-accused there is no direct evidence available on the record against petitioner, therefore without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Rohit Verma S/o Ganpatlal, in connection with FIR No. 615/2023 registered at Police Station Muhana, District Jaipur City (South) shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
