The petition, coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri Varun Byreddy, Advocate for the Petitioners and of Public Prosecutor for the Respondent, the Court made the following
THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 4138 OF 2025 ORDER: The Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioners/A1 to A3 to grant anticipatory bail in connection with Crime No.77/2025 of Banaganapalle Police Station, Nandyal District. A case has been registered against the petitioners for the offences punishable under Sections 109(2), 118(2), 329(4), 351(3) r/w 3(5) ofthe BNS. Case of the prosecution in brief is that this is a case of attempt to murder followed by trespassing into house causing injuries and threatening with dire consequence that occurred on 14.12.2024 at about 09:00 hours at old rice mill colony of Banaganapalle town, Nandyal District.
A private complaint was filed before the Magistrate concerned stating that with an intention to kill the informant, the accused trespassed in his house, tried to stab him with knife and beat him with stick and caused bleeding and swelling injury to his hand and also threatened him with dire consequence and all this is due to the property disputes between the informant and A1. A1 and A2 are own brothers of the informant and A3 is son of A2. 2. 3. 2 Heard. Perused the record. 4. to show that,
5. A perusal of the material available on record goes accused and the de facto there are civil disputes between the . In connection with that, an incident is said to have taken complainant hit the de facto complainant with place wherein A1 is alleged to have stick on his head, in order to avoid the same, he covered his head with left hand and got swelling on his left hand. It is further alleged that A1 brought a knife and tried to stab , in the stomach of the de facto of the wound certificate does not show any complainant. A perusal corresponding injury on the de facto complainant. By virtue of the same there are disputes amongst the accused family and the de facto as complainant and as the injuries received by the de facto complainant are simple in nature, this Court is inclined to consider the prayer of the petitioners for grant of anticipatory bail. Accordingly, in the petitioners/A1 to A3 shall be released on personal bond for a sum each, with two sureties for the like sum arresting police officials and also on make themselves available for investigation as event of their arrest with regard to this crime. 6. bail on their executing a of Rs. 10,000/- (Rupees ten thousand only) each to the satisfaction of the condition that the petitioners shall and when required and
