Learned counsel appearing on behalf of petitioner would submit that the petitioners’ ancestors were undisputed owner and bhumiswami of land bearing Khasra No. 55/2, Area- 2.10 acres, Khasra No.- 74, Area- 9 acres. In the year 1970, a partition was effected and part of the disputed land bearing Khasra No.- 74, Area- 4.44 acres fall in the share of the petitioner and thereafter, in the revenue records, the Khasra No.- 74, field map was deleted and thereafter, presently the respondent are disrupting the possession of the petitioners claiming petitioner land bearing Khasra No.- 74 as part of Khasra No.- 55 which is contrary to the revenue records and all the dispute has been created only because of the fact that the field map of the disputed land bearing Khasra No.- 74 has been mistakenly deleted from the records. That, due to the above mentioned facts, the petitioner moved an application under Section 107 of CG land Revenue code before the concerned Collector for revision of the field map but however, to the surprise of the petitioners, the Collector has refused to accept and register the application of the petitioner which is illegal, perverse and contrary to law, therefore he prays for a direction to register the application of the petitioner. 3. The State Counsel has not opposed the limited prayer made by the learned counsel for petitioner. 4. I have heard learned counsel for the petitioner. 3 5. Be that as it may, this Court finds it appropriate to dispose of the present writ petition with a direction to the respondent No. 2 Collector Kondagaon to register the application moved by the petitioner and decide the same in accordance with law, rules and regulations. 6. It is made clear that this Court has not expressed anything on the merits of the case. 7. With the aforesaid direction, the writ petition is disposed of. Sd/- (Arvind Kumar Verma) Judge Jyoti
