PUBLIC PROSECUTOR The Court made the fo[[owing: ORDER:I This Criminal Petition has been filed by the petitioner/A4, seeking anticipatory bail, in connection with crime No.216 of 2024 of Chilamathur Police Station, Sri Sathya Sai District. 2. A case has been registered against the petitioner herein and others for the offence punishable under Sections 109, 118(1),115(2) I/w3(5)ofBNS. 3. The brief facts of the case are that on 18.12.2024 at about 9.30 a.m., in front of complainant house at Peddanapalli village, --\- / .± 2 ChI'lamathur Mandal, Al to A5 formed into an unlawiul assembly with sickle, sticks and attacked the complainant, while he was checking the road work at Peddanapalli Village with an intention to kill him. Wherein Al attached the complainant with sickle and caused bleeding injuries, A2 was bet with stick and A3 to A5 bet him with hands and legs and also caused dumb injuries over his body. This is due to ill feelings between complainant and accused. The case was registered and investigated into. 4. Heard. Perused the record. 5. The learned counsel for.the petitioner submits that specific allegations have been made against Al and A2, who are accused of attacking the victim with a sickle. According to the prosecution's case, the petitioner/A4 was present at the time of the incident and beat the de`facto complainant with his hands and legs. The learned counsel for the petitioner further submits that due to ongoing disputes between the petitioner/A4 and the defacto complainan{, this false case has been registered against the petitioner, who is approximately 85 years old. Considering the nature of the allegations made against the petitioner, it is difficult for this Court, at this stage, to conclude that the ingredients of Section 109 of the lPC apply to the present petitioner. `_.`,.-`--` I-, +`'. 3 6. Considering the old age of the petitionerand the petitioner has a permanent abode at Peddanapalli Village, Sri Satya Sai District, and there is no possibility of his fleeing away from the Jurisdiction of the Court. lt is submitted that Al and A2 already arrested and release of the petitioner would not ca'use hampering of investigation, thl's Court is inclined to grant anticipatory bail to the petitioner hereI-n/A4. 7. In the result, the criminal petition is allowed by granting anticipatory bail to the petitioner/A4 subject to his surrender before the investigating officer concerned within two (o2) weeks from today. On such surrender, the petitioner shall be released on bail on his furnl-shing a personal bond for Rs.10,000/- (Rupees ten thousand only) with one surety for a lI'ke Sum tO the satisfaction of the concerned investigating officer. upon this release, the petitioner is mandated to adhere to the following conditions: L (i) 'The petitioner/A4 is directed to appear before the COnCerned investigating Officer aS and When required; and (ii) The petitioner/A4 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any investigating or police officer and shall cooperate with the investigating officer. -, t\ Es' i= |^ \+.xp'= |` .,.` cr 4 8.
