1. The instant criminal misc. petition has been filed under Section 528 BNSS for quashing the proceedings arising out of the FIR No.69/2018 registered with Police Station Mahila Thana, Jaipur City (South) on the basis of compromise.
2. Counsel for the petitioner submits that a compromise has been arrived at between the parties and it is borne out from the compromise that the complainant is not inclined to proceed further in this matter. Counsel has placed reliance upon the judgments passed by the Apex Court in the case of Gian Singh Vs. State of Punjab reported in 2012 (10) SCC 303 and The State of Madhya Pradesh vs. Laxmi Narayan reported in 2019 (5) SCC 688. It is also stated that the Trial Court has verified the compromise vide its order
(2 of 2) [CRLMP-7551/2025] dated 16.09.2025 and discharged the petitioner form the charge under Section 323 IPC, however, the Trial Court has declined to verify the compromise for the other offence i.e. under Sections 498-A IPC on the ground that the said offence is not compoundable.
3. In view of the aforesaid compromise and the situations narrated herein above and looking to the fact that the compromise has been arrived at between the parties as well as the aforesaid order dated 16.09.2025 passed by the Trial Court and also applying the principles laid down by the Apex Court in the case of Gian Singh (supra) and Laxmi Narayan (supra), this Court deems it just and proper to invoke inherent powers of this Court contained under Section 528 BNSS.
4. Accordingly, the instant criminal misc. petition stands allowed. The petitioner is discharged from the charge under Section 498-A IPC and the proceedings arising out of the FIR No.69/2018 registered with Police Station Mahila Thana, Jaipur City (South) stand quashed.
5. The stay application and all pending applications, if any, stand disposed of.
