Learned counsel appearing on behalf of the petitioner submits that the petitioner herein is shown as Accused No.7 in all the crimes and he was implicated basing on the confessional statement of co-accused. Except, the confessional statement, there is no other incriminating material against him. Apart from that, the petitioner has been shown as Accused-7 for the reason that he stood as witness in the document. Therefore, he requested to allow the applications. Learned Assistant Public Prosecutor for the Respondent/ State submits that in the confessional statement of the purchasers, it is alleged that the petitioner herein is the person, who created the documents, after knowing that the owners of the lands and their legal heirs were not traceable. Perused the record. 7) The prosecution case is that the petitioner along with other Accused is alleged to have involved in creating Sale Deeds and fabricated Title Deeds of the owners of the lands, who are not traceable. The said Crimes were registered in the year 2023. In the month of January-2025, Police recorded the statements of respective purchasers of the land from Accused-1, wherein the petitioner is said to have been a witness in the sale deed. There is absolutely no explanation for the delay so caused. Apart from the same, basing on the confessional statement of the Co-Accused, the name of the petitioner was shown as Accused-7 at belated stage i.e after lapse of two years. 8) It is pertinent to mention here that in respect of Accused-6 in Crime No. 774 of 2023, this Court granted anticipatory Bail in Crl.P.No.9748 of 2023, dated 09.01.2025. Therefore, it can be safely inferred that the petitioner stand on the same footing as that of Accused No.6. The petitioner has fixed abode and the question of he absconding does not arise. In view of the said reason, this Court is inclined to grant anticipatory bail, however, on certain conditions. 9) Accordingly, in the event of the arrest of petitioner/A7 with regard to these crimes, he shall be released on bail on his executing a personal bond p f \ for a sum of Rs. 10,000/- (Rupees ten thousand only) each with two sureties each for the like sum to the satisfaction of the arresting police officials and also on condition that the petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses. Petitioner shall appear before the Station House Officer concerned everyday between 10.00 a.m. and 05.00 p.m., till filing of the charge-sheet, except on those days, where he has to attend the Court. 10) Accordingly, the Criminal Petitions are allowed by a Common Order.
