2. Before the trial court, the Revision Petitioner filed an application in I.A.No. 18 of 2025 to implead himself as a necessary party to the proceedings as he purchased the property pending suit in the year 2014. According to him, the 2nd defendant sold the property to him. Therefore, he is the necessary party to the proceedings, otherwise, it will lead to multiplicity of proceedings, for that, the 1st respondent/plaintiff has not raised any objections. But, the trial judge found that he was not necessary party to the proceedings for the reason that the suit is of the year 2009 and if any alienation is made in the year 2016, pending proceedings, it would hit principles of lis pendens. Therefore, he was not necessary party to the proceedings. Accordingly, the trial judge dismissed the application. Aggrieved over that, the Revision Petitioner/proposed defendant preferred this Civil Revision Petition. 3. Though the reason assigned by the Revision Petitioner is acceptable one, pending suit, he purchased the property, in future, if the vendor not proceeded with the matter, the purchaser, who entered into agreement with the 2nd defendant, the Revision Petitioner is entitled to proceed with the matter. But, the trial judge failed to take note of the same and it will also lead to multiplicity of proceedings.
Therefore, this Court is inclined to set aside the findings rendered in I.A.No. 18 of 2025 in O.S.No.4551 of 2009 by the XIII Assistant Judge, City Civil Court, Chennai. Accordingly, this Civil Revision Petition is https://www.mhc.tn.gov.in/judis
