Heard on maintainability of the petition. 2. Learned counsel for the respondent/State contended that the Board of Revenue in exercise of its revisional jurisdiction passed the order under Section 50 of the Chhattisgarh Land Revenue Code, 1959 and in view of the law laid down by the Division Bench of this Court in Writ Appeal No. 560 of 2022, judgment delivered on 24.07.2023, the order of Board of Revenue in exercise of its revisional jurisdiction only and only the writ petition under Article 227 of the Constitution of India would be maintainable. 3. In this regard, learned counsel for the petitioners contended that the order of Board of Revenue is challenged before this Court either under Article 226 or Article 227 of the Constitution of India and both are maintainable in exercise of its revisional jurisdiction. 4. The prayers and content of the petition under Article 226 of the Constitution of India, thereunder being once requiring exercise of supervisory jurisdiction only and could be treated as petition filed only under Article 227 of the Constitution of India. In that view of the matter, against the order of Board of Revenue in exercise of its 4 revisional jurisdiction only and only a writ petition under Article 227 of the Constitution of India would be maintainable. 5. Therefore, this Court is of the considered view that the writ petition under Article 226 of the Constitution of India filed by the petitioner against the order of Board of Revenue in exercise of its revisional jurisdiction is not maintainable, as such it is dismissed at this stage only on the ground of maintainability, however with liberty to file fresh petition in accordance with Article 227 of the Constitution of India. 6. The certified copy of the relevant documents be returned to the learned counsel for the petitioners after furnishing the photocopy of the same. 7.
