ORDER (Order of the Court was made by the Hon'ble Chief Justice) This petition has been filed seeking a Writ of Mandamus directing respondents 1 to 5 to take immediate action for removal of encroachments made by the private respondents in S.Nos.238 and 239, in Seeyamangalam Village, Vandhavaasi Taluk, Tiruvannamalai District, based on petitioner’s representation dated 10.12.2024. 2. The respondents were directed to file status report. The third respondent has filed a status report wherein it is stated thus: “4.It is submitted that later point in time, the land in Survey No.238/1 was reclassified as ‘Government poromboke – Thoppu’ and land in Survey No.238/3 was reclassified as ‘Government poromboke – Natham’ vide proceedings dated 14.02.1974 in DRO.Roc.C1/60093/73 and subsequently, vide proceedings dated 13.09.2000 in Na.Ka.B1/ https://www.mhc.tn.gov.in/judis WP No.49902 of 2025 37884/2000 of the District Collector of Tiruvannamalai, the said land in Survey No.238/1 was reclassified as ‘Government poromboke – Natham’ for issuance of house-site pattas to several persons and thereby presently the lands in Survey Nos.238/1 & 238/3 stand sub-divided with 171 sub-divisions and house-site pattas have been issued to various persons who are in possession and occupation of their respective portions who have built houses and residing thereon. 5.It is thus submitted that the lands in Old Survey Nos.238/1 & 238/3 are not Government lands as claimed by the writ petitioner and whereas they are now under possession and occupation of the Pattadhars. Only the lands in Survey No.238/2 (School) and Survey No.239 (kumal) are Government lands and for which field inspection and survey was conducted on 28.01.2026 and it was found that these Government lands are free from encroachments. 6.It is further submitted that upon scrutiny of the revenue records and village map it was found that there is no water channel in Survey No.238 as alleged by the writ petitioner.” https://www.mhc.tn.gov.in/judis WP No.49902 of 2025 3. As per the status report there is no encroachment on the aforesaid lands. This petition is totally misconceived. Accordingly, it stands dismissed. There will be no order as to costs.
