The present writ petition has been filed seeking directions to de- seal/remove the seal by the Municipal Corporation of Delhi (“MCD”) in Shop No. 272, Naharpur Village, Sector-7, Rohini, Delhi-110085, owned by the petitioner. 2. Learned counsel appearing for the petitioner submits that the petitioner is seeking similar directions as passed by this Court vide order dated 11th July, 2025, in W.P.(C) 8818/2023, titled as “Anand Yadav & Anr. Versus Municipal Corporation of Delhi”. 3. Learned counsel appearing for the petitioner submits that the shop of the petitioner herein is identically placed as the shop of the petitioner in W.P.(C) 8818/2023, as the same was also sealed by the respondent-MCD pursuant to NGT order dated 04th October, 2018, wherein, it was directed to take action against the persons who were carrying on the activities of This is a digitally signed order. Learned counsel appearing for the petitioner submits that petitioner is the owner of property being Shop No. 1, Net Ram Market, Plot No. 272, Naharpur Village, Delhi-110085. She further submits that the tenant of the petitioner was carrying on the activity of only stitching car seat covers and no activity of servicing, repairing, denting, painting, etc. was being carried out from the Shop of the petitioner. 5. It is further submitted that the petitioner undertakes that in future he or his tenant, will use the premises only for the activities which are permissible under the Master Plan for Delhi, 2021 (“MPD 2021”) and after taking due licenses and approvals. 6. She further submits that a representation dated 25th September, 2025, has also been filed by the petitioner before the MCD, seeking parity in terms of the order dated 11th July, 2025, in W.P.(C) 8818/2023. 7. Responding to the present writ petition, learned counsel appearing for the respondent-MCD submits that the earlier writ petition being W.P.(C) 8818/2023, was entertained by this Court, since, there was no Presiding Officer in the Appellate Tribunal MCD (“ATMCD”), at that point of time. She further submits that the appeal of the petitioner herein is pending before the ATMCD, and is next listed on 31st October, 2025. 8. Considering the submissions made before this Court, the petitioner is granted liberty to bring to the notice of the ATMCD, the order dated 11th July, 2025, passed by this Court in W.P.(C) 8818/2023, titled as “Anand Yadav & Anr. Versus Municipal Corporation of Delhi”. 9. The ATMCD is requested to consider the case of the petitioner on the next date of hearing, and pass appropriate orders, accordingly.
