This Second anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 101/2025 registered at Police Station – Gandai, District - Khairagarh-Chhuikhadan-Gandai (C.G.) for the offence punishable under Sections 318(4), 336(3), 338 and 340(2) of Bharatiya Nyaya Sanhita, 2023. Earlier first bail application of the applicant was rejected by this Court vide order dated 03.09.2025 passed in MCRCA No. 1331/2025, on technical grounds. 3. As per the prosecution's case, on 25.04.2025 written complaint was made by one Ankalhu Ram Janghel that the applicant has obtained birth certificate on the basis of forged 'Jachcha-Bachcha Raksha Card' which was investigated in which it was found that the applicant has submitted forged application before the Tahsil Office, Gandai regarding date of birth certificate and the present case was registered against the applicant. 4. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is submitted that the earlier first bail application of the applicant was not rejected on merits. She further submitted that the anticipatory bail application of the co-accused person, namely, Laxminath Lodhi @ Laxminath Verma who is the father of the present applicant has already been granted by this Court vide order dated 08.04.2025 passed in MCRCA No. 486/2025. A copy of the bail order dated is annexed herewith and marked as Annexure A/3. She further submit that the applicant has pending criminal case registered as Crime No. 41/2023 for offences under Sections 279, 337, 338 of I.P.C and offences under Sections 3/181, 4/181, 5/180, 103(3)/177, 146/196 of M.V. Act in police station Gandai, Distt. K.C.G, against him. The case no. 96/2023 is at present pending before Juvenile Justice.Therefore, he prays for grant of anticipatory bail to the applicant. 3 5. On the other hand, the learned State Counsel opposes the bail application. 6. I have heard learned counsel for the parties and perused the materials available on record. 7. Considering the facts and circumstances of the case, nature and gravity of allegation leveled against the applicant, and the fact that the anticipatory bail application of the co-accused person, namely, Laxminath Lodhi @ Laxminath Verma who is the father of the present applicant has already been granted by this Court vide order dated 08.04.2025 passed in MCRCA No. 486/2025, hence, this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case. 8. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Pramod Verma on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade his from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which 4 shall be verified by the trial Court.
