The petitioners are aggrieved by an order dated 11.6.2024, whereby the Deputy Registrar of the Gautam Budh Nagar University has held that they were not employees of the University. 2. A preliminary objection has been raised by the learned counsel appearing for the University regarding maintainability of the petition in view of the alternative remedy available to the petitioners under the provisions of the U.P. Industrial Disputes Act, 1947. 3. Though, the learned counsel for the petitioners has not been able to dispute the availability of the alternative remedy under the U.P. Industrial Disputes Act, he states that the petitioners have been working in the University since a very long time and they deserve to be reinstated in service. 4. Having heard the counsel for the parties, it is evident that the issues sought to be raised by the petitioners in the instant petition are disputed questions of fact. Moreover, as pointed out by learned counsel appearing for the University, the appropriate remedy available to the petitioners is to raise an industrial dispute under the provisions of the U.P. Industrial Disputes Act. 5. Therefore, this petition is dismissed leaving it open for the petitioners to approach the appropriate forum as they may be advised. Order Date :- 20.5.2025 A. V.
