ORAL ORDER
1. This petition is filed by respondent in Crl.Misc.No.264/2022 challenging the Order dated 03.11.2022 on the file of I Addl. Prl. Judge, Family Court, Hubballi, granting maintenance to the respondent herein.
2. For the sake of convenience, parties are referred with reference to their ranking before the Family Court, Hubballi.
3. It is the case of the petitioner that marriage between the petitioner and the respondent was solemnized on 22.08.2010. It is also stated that, after the marriage, the petitioner joined the respondent for leading marital life for few months and thereafter, a child was born to them. It is also stated that respondent and his family members were harassing petitioner No.1 physically and mentally, and as such, the petitioner has left the matrimonial home having not been able to tolerate the inhuman treatment meted out to her and accordingly, the petitioner has filed Crl.Misc.No.264/2022, before the Family Court, seeking maintenance.

4. After service of notice, respondent remained absent and he was placed ex-parte. Hence, the Family Court, after considering the material on record, by its Order dated 03.11.2022, granted maintenance of Rs.8,000/- per month to the respondent herein. Feeling aggrieved by the same, the respondent / husband has preferred this petition.
5. Sri. Ashok T. Kattiimani, learned counsel for the petitioner herein, contended that the award of maintenance granted by the Family Court is on the higher side and no fair opportunity was extended to the petitioner.
6. In the backdrop of the arguments made by the learned counsel for the petitioner, I have carefully examined the records. It is not in dispute that marriage between the petitioner and the respondent was solemnized on 22.08.2010 and in their wedlock, a child was born. Taking into
consideration that the notice issued by the Family Court is duly served to the respondent, however, the petitioner herein deliberately did not participate in the proceeding, the Family Court, considering the factual aspects, has rightly allowed the petition and granted maintenance to the petitioner.

7. In that view of the matter, the finding recorded by the Family Court is just and proper and requires to be confirmed in this Revision Petition.
8. Accordingly the Revision Petition is dismissed.
