1. By way of this petition, petitioner sought following relief(s) :
“10.1 That, this Hon'ble Court may kindly be pleased to direct the respondent no.2 & 3 to consider and
2 decide the application dated 01.09.2025 and 10.09.2025 filed by the petitioner for grant of issuance of dharnadhikar patta of land bearing Khasra No. 448/11 rakba 0.014 hectare situated at Village Himri, Tahsil Suhela District Balodabazar Bhatapara (C.G), within some stipulated period of time, in the larger interest of justice. 10.2 Any other relief (s) that this Hon'ble Court may deem fit to grant in the interest of Justice.”

Learned counsel for the petitioner contended that the instant Writ Petition is being preferred by the petitioner with a limited prayer that the petitioner is in possession over about 0.014 Hectare (3.5 Dismil) of Abadi land bearing Khasra No. 448/11 situated at Village Hirmi, Tahsil Suhela District Balodabazar Bhatapara (C.G) by constructing a house and cultivating it from lifetime of his father since 30 years and has made application before respondent no.2 & 3 for grating him possessory rights patta (Dharnadhikar patta) in similar manner as has been granted/ distributed to all the villagers of same Abadi land 448 in the survey list of village, but the Halka Patwari (Resp no.4) is not giving him his patta, therefore he has made application dated 01.09.2025 to respondent no.3 (Tehsildar) and application dated 10.09.2025 to respondent no.4 (Collector) but no action has been taken by the respondent authorities.The grievance and limited prayer of the petitioner is that the petitioner has filed application before the respondent no.2 and 3 to grant him Dharnadhikar patta of the said land as granted to adjacent land holders but the same has not been considered, which may kindly be

directed to be considered within stipulated period of time. Hence this petition.
3. Learned State counsel contended that he has no objection to decide the application/representation of the petitioner as per law.
4. I have heard learned counsel for the parties and perused the record with utmost circumspection.
5. Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing to respondent No.2 – Collector Baloda Bazar Bhatapara, District Baloda Bazar to decide the application/representation made by the petitioner dated 10.09.2025 (Annexure P-3) as expeditiously as possible, in accordance with rules, regulations and law.
6. It is made clear that this Court has not expressed any opinion on the merits of the case.
