Neutral Citation No. - 2025:AHC:63774 Court No. - 32 Case :- WRIT - C No. - 11637 of 2025 Petitioner :- Committee Of Management, Gyan Prakash Inter College Bhaluani Deoria And Another Respondent :- State Of Up And 2 Others Counsel for Petitioner :- Vinod Kumar Singh Counsel for Respondent :- C.S.C. Hon'ble Saral Srivastava,J.
1. Heard Sri Vinod Kumar Singh, learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
2. The petitioner by means of the present writ petition has prayed for the following relief:-
"i. Issue a writ, order or direction in the nature of mandamus restraining the respondent no.3 to pass salary bill of the institution with his own signature in view of the order of Hon'ble High Court dated 06.12.2024 as well as order dated 06.02.2025. ii. Issue any other suitable writ, order or direction as this Hon'ble Court may deem fit and proper under the facts and circumstances of the case. iii. Award the costs of the writ petition in favour of petitioner."
3. It is contended by the learned counsel for the petitioner that despite the order passed by this Court on 06.02.2025 in Writ-C No.39511 of 2018, the respondent no.3 is still passing the salary bills of the institution, and therefore, action of respondent no.3 is arbitrary and illegal.
4. Be that as it may, if there is violation of order passed by this Court in Writ-C No.39511 of 2018, the present writ petition for compliance of the order passed in Writ-C No.39511 of 2018 is not the proper remedy for the petitioner.
5. Accordingly, present writ petition is dismissed with liberty to the petitioner to avail appropriate remedy available in law. Order Date :- 25.4.2025 Sattyarth Digitally signed by :- SATTYARTH ANAND High Court of Judicature at Allahabad
