Rawat, learned counsel for the applicant. 2. By means of the present criminal misc. application, applicant has challenged the following reliefs:- “(1) Summoning order dated 22.07.2016 passed by the learned Additional Chief Judicial Magistrate, Kashipur, District – Udham Singh Nagar, in Criminal Complaint Case No. 2556 of 2016, Sri Pawan Kumar Rawal Vs. Sunil Malhotra punishable under Section 138 of Negotiable Instrument Act. (2) Entire proceedings of Criminal Complaint Case No. 2556 of 2016 Sri Pawan Kumar Rawal Vs. Snil Malhotra punishable under Section 138 of Negotiable Instrument Act pending before the court of learned Addl. Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar.” 3. During pendency of this criminal misc. application, a report was called from the Daily Lok Adalat about the status of the case pending before the Trial Court. As per the report dated 23.04.2025 submitted by learned Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar, it has come that the said criminal complaint case has been dismissed for default on 23.06.2022 and the file has been signed to the record. 4. Taking into consideration the report submitted by learned Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar, this Court is of the view that no cause of action survives in the matter. 5.
