Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a writ order or direction more particularly one in the nature of the writ of mandamus declaring the action of the Respondent No.3, in not disposing of the Appeal vide ROC.A/2159/2025, which was filed by the petitioners on 21.12.2020, is nothing but illegal, arbitrary, unjust and violation of the fundamental rights guaranteed under Articles 14, 21 and 300- A of the Constitution of India and consequently direct the Respondent No.3 to dispose of the petitioners' Appeal vide ROC.A/2159/2025 and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondent No.3 to dispose of the petitioners' Appeal vide ROC.A/2159/2025, pending disposal of the Writ Petition and pass Counsel for the Petitioner(S):

The writ petition is filed for the following relief:
“…to issue a writ order or direction more particularly one in the nature of the writ of mandamus declaring the action of the Respondent No.3, in not disposing of the Appeal vide ROC.A/2159/2025, which was filed by the petitioners on 21.12.2020, is nothing but illegal, arbitrary, unjust and violation of the fundamental rights guaranteed under Articles 14, 21 and 300-A of the Constitution of India and consequently direct the Respondent No.3 to dispose of the petitioners' Appeal vide ROC.A/2159/2025 and pass such other order or orders…”
2. The contention of the petitioner is that the 3rd respondent has entertained the appeal and issued notices, but has not proceeded to decide the appeal. 3. The learned Assistant Government Pleader for Revenue, appearing on behalf of the respondents, on written instructions, has submitted that On 20.09.2025, when the matter was taken up, it was brought to the notice of the authority that respondents 2 and 6 have passed away, and accordingly, the matter was adjourned with a direction to substitute the legal heirs of respondents 2 and 6 therein. 4. In reply, the learned counsel for the petitioner has submitted that steps have already been taken to substitute the legal heirs of respondents 2

to 6. However, despite the conclusion of the hearing, the authorities have not passed any orders. 5. As this Court is not going through the merits of the case, notice to respondents 5 and 6 is dispensed with. Considering the submissions, the writ petition is disposed of directing the 3rd respondent to consider the appeal filed by the petitioner, after issuing due notice to all concerned parties. The said exercise shall be completed within a period of three months from the date of receipt of a copy of this order. No costs. 6.
