The present criminal petition is filed seeking to quash the PRC.No.7 of r 2023 on the file of Judicial Magistrate of First Class, Alur. 2. Today, when the matter is taken up for hearing, the 3'''^ respondent has filed counter stating that he has not filed any complaint against the petitioner and also further submits that he has not aware if the police mentioned his name in his statement or the statements of the other witnesses and he is an illiterate and further submits that the police have filed charge sheet in the present case. The police officials obtained his signature on papers and he do not know the contents on papers. 3. Recording the same, PRC.No.7 of 2023 is hereby quashed though the provision of law mentioned i.e.. Section 489-B of IPC and as seen from the charge sheet, the alleged counterfeit currency was not recovered from the petitioner. On these grounds, the criminal petition is hereby quashed. 4. Considering the same, continuing the PRC.No.7 of 2023 on the file of Judicial Magistrate of First Class, Alur, would be a futile exercise and relegating the matter for trial in the wake of the filing of the counterby the 3^^ respondent would be of no consequence. 5. Under these circumstances, PRC.No.7 of 2023 on the file of Judicial Magistrate of First Class, Alur is hereby quashed against the petitioner. Accordingly, the criminal petition is allowed.
