SREENIVASA REDDY CRIMINAL PETITION NO.729 OF 2025 ORDER : This Criminal Petition,-under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A5, seeking regular bail, in Crime No.240 of 2024 of Rajahmundry I Town Police Station, East Godavari District. 2. A case has been registered against the petitioner herein and others for the offence punishable under Section 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short lthe NDPS Act'). 3. Case of the prosecution, 'ln brief, is that, on 10.10.2024 at about 4-OO p.m., the Sub-Inspector of Police, Rajahmundry I-Town Police Station`, along with his staff and mediators rushed tO Godavari Bund, Rajamahendravaram and found Al to A3 in possession of 21.660 Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that basing on the confessional statement of co-accused, the petitioner herein was shown as accused in the present crime. Except the confessional .izf , LIE E statement of co-accu.sed, there is no o`ther material to connect the Petl'tI-Oner herein to the alleged crime. The petI-tiOner herein was arrested on o6.ll.2024 and since then he is languishing in jail. lt is subml-tted by the learned counsel for the petitioner that other accused in the present crime were already granted bail by this Court. The case of the petitioner herein also stands on the same footing to that of the A2. Learned Assistant Public Prosecutor submitte-d that major portion of investigation has been completed. 6, ln view of the aforesaid facts and circumstances of the case, this court is inclined to grant bail to the petitioner/A8 on the followI'ng condI'tl'OnS. l') The petitioner/A5 sha" be released on bail on his executing personal bond for Rs.50,000/- (Rupees Fifty Thousand only) with two sureties of the like sum each to the satisfactI'On Of the learned lI Additional Judicial First class MagI'Strate, Rajamahendravaram, East Godavari District. ii) On release, the petitl'oner/A5 shall appear before the station House Officer concerned, every day between 10.00 am and o1.00 pm, till filing of the charge sheet. 7.
