1. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with Crime No. 66/2025 RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI
2 registered at Police Station – Saliha, District – Sarangarh-Bilaigarh (C.G.) for the offence punishable under Section 191(2), 221, 296, 132, 121(1), 329, 331(5) and 352 of the BNS. 2. The prosecution story, in brief, is that president block Congress Committee, Bilaigarh namely Deepak Tandan has called protest against the inaction of the Police personals of Police Station Saliha who have not taken any strict action on the complaint made by the villagers of villages situated under the area of the Saliha Police Station. That, the people of the locality have made many complain with regard to illegal activities like gambling, illegal sale of liquor and cattle smuggling have been going on continuously in the area of Saliha police station for a long time. Information about all this has been given to the police administration earlier also, but no concrete and effective action has been taken by the Police of Police Station Saliha. Due to these illegal activities, crime is increasing in the society, the young generation is falling prey to drug addiction and the law and order situation is continuously deteriorating.
That, due to non action of the complaint made by the people of the locality, so on call of the said Deepak Tandan, they appeared in front of the police station and were protesting peacefully, then the police started pushing them with the help of sticks to escape, at the same time there was a minor scuffle between the protesters and the police, no one was hurt, due to the said incident, but the police of Police Station Saliha has registered the FIR against the protesters and the present applicants for the offence punishable Under Section 191(2), 221, 296, 132, 121(1), 329, 331(5) and 352 of BNS and the police sought to arrest the applicants in the alleged commission of offence. Hence, this application. 3. It has been argued by the learned counsel for the applicants that the
3 applicants are innocent and have been falsely implicated in this case. It is submitted that the co-accused president Block Congress Committee, Bilaigarh namely Deepak Tandan and other people of the locality have made many complain with regard to illegal activities like gambling, illegal sale of liquor and cattle smuggling have been going on continuously in the area of Saliha Police Station for a long time, but the Police of Police Station – Saliha, has not taken any strict action against the aforementioned activities, therefore, the protesters and the applicants have made protest by smutting letter dated 18.08.2025 and 21.08.2025 to the SDO, Bilaigarh and Police Station – Saliha, but instead of taking action against the aforementioned activities, the Police has registered the FIR against the protesters and the applicants. Therefore, he prays for grant of anticipatory bail to the applicants. 4. On the other hand, learned State counsel opposed the bail application and submits that the applicants are not entitled for grant of anticipatory bail in this case. 5. I have heard learned counsel for the parties and perused the materials available on record. 6.
Considering the facts and circumstances of the case, nature and gravity of allegation leveled against the applicants, and from the perusal of the case diary it transpires that the co-accused president Block Congress Committee, Bilaigarh namely Deepak Tandan and other people of the locality have made many complain with regard to illegal activities like gambling, illegal sale of liquor and cattle smuggling have been going on continuously in the area of Saliha Police Station for a long time, but the Police of Police Station – Saliha, has not taken any strict action against the aforementioned activities, therefore, the protesters and the applicants
4 have made protest by smutting letter dated 18.08.2025 and 21.08.2025 to the SDO, Bilaigarh and Police Station – Saliha, but instead of taking action against the aforementioned activities, the Police has registered the FIR against the protesters and the applicants, at this stage without expressing any opinion on merits, this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants – Lilaman Singh Thakur, Kiritram Netam, Bhawani Shankar Ratre and Dayman Singh Kanwar @ Diamond Kanwar, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
(d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
