10.3. That the Hon’ble Court may kindly be pleased to set aside/quash the order dated 18.102.2024 (Annexure P/6)
10.4. Any other relief which the Hon’ble Court may deem fit in the interest of justice.”

Learned counsel for the petitioner submits that had passed out class 10th examination from the Board/respondent No.2 however due to typographical error, the date of birth of the petitioner has been wrongly mentioned as 22.11.2013 in place of 22.11.2003. In support of his contention, the academic documents, Aadhar card, Dakhil Kharij register etc. were placed on record. He submits that the petitioner had submitted a representation along with affidavit to the respondent for correction in the mark sheet but the respondent/authority did not considered the same and he therefore submits that direction may be issued to the respondent NO.2 to consider the application of the petitioner and to make necessary correction in the date of birth in the mark sheet of the petitioner expeditiously.

Learned counsel for the respondent No.2 submit that the Board in its meeting held on 28.02.2022 had resolved those applications for change in the date of birth in the mark sheets issued for classes 5th, 8th and 10th to be submitted to the Board within three years from the date of publication of the respective results. The petitioner in the instant case has approached the Board beyond the stipulated period of three years as such, the request for correction in the date of birth could not
3 be considered or entertained.

In view of the submissions of the counsel for the parties, the writ petition is disposed of permitting the petitioner to file representation afresh and in the event of filing any such representation, the same shall be decided by the respondent No.2/Board in accordance with law within a period 8 weeks from the date of receipt of the said representation.
