This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “to issue an appropriate Writ or order or direction more particularly one in the nature of a Writ of Mandamus declaring the action of respondent authorities in issuing form Form-VII declaration under section 19(1) of Act 30 of 2013 vide R.O.C. G5/5104 (E-479420/2024)/ Shantipuram/2025, R.O.C.G5/5104 (E79420/2024)/ Ammavaripeta/ 2025, R.O.C.G5/5104(E- 479420/2024)/Maneendram/2025 and R.O.C.G5/5104 (E-479420/2024) /Sonneganipalle/2025 dated 22-11-2025 to acquire lands belonging to the Petitioners herein, allegedly for Development of Airport at Kuppam in Chittoor District, without satisfying proviso of section 15(2), 16, 17 and 18 of Act 30 of 2013 and proceeding further with award enquiry as illegal, unconstitutional and consequently set-aside declaration under section 19(1) of Act 30 of 2013 vide, R.O.C. G5/5104 (E-479420/2024) /Shantipuram/2025, R.O.C.G5/5104 (E79420/2024)/ Ammavaripeta/ 2025, R.O.C.G5/5104 (E-479420/2024) /Maneendram /2025 and R.O.C.G5/5104 (E-479420/2024) /Sonneganipalle /2025 dated 22-11-2025 issued by District collector, Chittoor and pas…” 2. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 3. The learned counsel for the petitioners submits that the respondent authorities issued Form-VII declarations under Section 19(1) of Act No.30 of 2013, vide R.O.C. G5/5104 (E-479420/2024)/Shantipuram/2025, R.O.C. G5/5104 (E-479420/2024)/Ammavaripeta/2025, R.O.C. G5/5104 (E- 479420/2024)/Maneendram/2025, and R.O.C. G5/5104 (E- 479420/2024)/Sonneganipalle/2025, all dated 22.11.2025, proposing to acquire the lands belonging to the petitioners, allegedly for the development of an Airport at Kuppam in Chittoor District, without complying with the mandatory proviso to Sections 15(2), 16, 17, and 18 of Act No.30 of 2013, and that proceeding further with the award enquiry is illegal. 4. On the other hand, the learned Government Pleader for Land Acquisition appearing for the respondents submits, on instructions, as directed by division bench of this court in Writ Appeal No.1151 of 2025, the authorities have considered the matter and passed orders strictly in accordance with law and in compliance with the observations made by the Division Bench in the said appeal. 5. However, insofar as the specific query raised by the learned Senior Counsel for the petitioners is concerned, placing reliance on Section 15(2) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act No.30 of 2013), which mandates that the Collector shall conduct the Social Impact Assessment in consultation with the Gram Sabha or Municipalities and take into consideration the views of the affected families before proceeding further with the land acquisition, it is evident that the said provision prescribes a mandatory procedure prior to submission of any report to the Government. In the instant case, the learned Government Pleader is not able to place on record any report forwarded by the District Collector under Section 15(2) of the Act. 6. In view of the said circumstances, without going into the merits of the case, the writ petition is allowed by setting aside the impugned enquiry initiated under Section 19(1) of Act No.30 of 2013, vide proceedings dated 22.11.2025, and by directing the 2nd respondent to issue a notification fixing the date and time for filing objections and for conducting a hearing, as mandatorily required under Section 15(2) of Act No.30 of 2013. Upon completion of the said process, the District Collector may submit the report to the concerned authority before proceeding further in accordance with law. 7. With the above direction the writ petition is allowed. No order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed. ________________________ JUSTICE D.
