The petitioner claims that he is entitled to salary from the period of July, 2023 to October, 2023. A representation in this regard has been made but to no avail. Learned Standing Counsel for the respondents No.1 to 2 and Shri Mukesh Kumar, learned counsel for the respondents submit that the matter requires factual determination as per applicable law by the competent authority in the first instance. They, however, fairly contend that the issue regarding payment of his salary from the period of July, 2023 to October, 2023 has to be determined by the competent authority within a reasonable time frame. In wake of the preceding discussion and without going into the merits of the case, the respondent No.4-Executive Officer, Nagar Panchayat Mohammadabad, District- Farrukhabad is directed decide the representation of the petitioner regarding payment of his salary from the period of July, 2023 to October, 2023 as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of representation.
