2. Mr. Udane, the learned Counsel for the petitioner, on instructions, seeks leave to withdraw the petition with liberty to raise the contentions at the stage of final hearing of the suit.
3. Mr. Udane also expressed an apprehension that the observations in the impugned order may weigh with the Court while finally adjudicating the suit.
4. The petition stands dismissed as withdrawn.
