1. The petitioner has filed this writ petition on the following reliefs:
“10.1. That, this Hon’ble Court may kindly be pleased to allow this petition and direct
2 the respondent authorities to decide the application dated 24.06.2025 (Annexure P/1) within prescribed time limit. 10.2 That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.”
2. Learned counsel for the petitioner submits that the petitioners are the real sisters and their brother namely Lakheshwar has died. They were the joint owners of property bearing khasra no. 242/2, 247, 1046 total area 1.0930 hectares, situated at Village- Baloda, P.H. No. 14, District- Janjgir-Champa (C.G.). After the death of brother of the petitioners, his ex-wife remarried with one Lakhan Bharadwaj and through their wedlock a girl namely Heera Bai was born. The ex-wife of the deceased brother of the petitioners got her daughter’s name Heera Bai added in the revenue records.
3. Learned counsel for the State submits that there is a dispute of property between the petitioners and one Heera Bai who has not been made a party to the petition. Therefore the petition is defective and is liable to be dismissed.
4. Heard learned counsel for the respective parties and perused the record with utmost circumspection.
5. Considering the entire facts and circumstances of the case,
submissions of the counsels for the respective parties, particularly the fact that there is a dispute of property between the petitioners and one Heera Bai who has not been made a party to the petition.
3 Therefore the petition is defective and also because there is a civil dispute of property which is not maintainable before this Court.
6. With the aforesaid observation/direction, the petition stands dismissed. Sd/-
