«5 Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to pass an order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent No.5 in issuing the 'impugned Endorsement vide RC.No.372/2025, dated: 07.03.2025, allotting the land of an extent of Ac.7.12 in Sy. No. 847 in Thikkavaram Village, Chillakur Mandal, Tirupati District to the third parties during pendency of appeal before the 4*^ respondent bearing Rc. B2 217/2023 as illegal and arbitrary and apart from being violation of the fundamental rights guaranteed to us under Articles 14, 19, 21 and 300-A of the Constitution of India and consequently to set aside the above said impugned Endorsement bearing RC.No.372/2025, dated: 07.03.2025. The learned counsel for the petitioners submits that the petitioners preferred an appeal against the order dated 03.12.2022 in RGB No. 625/2020, passed by the 5th respondent. The said appeal is pending before the 4th respondent. However, during the pendency of the appeal, the 5th respondent passed the impugned order in Rc. No. 372/2025, dated
07.03.2025. While the appeal is still under
consideration, the 5th respondent is trying to allot the petitioners' land, admeasuring to an extent of Ac. 7.12 in Sy. No. 847, situated at Thikkavaram Village, Chilakalur

rX*' Mandal, Tirupati District, to third parties, which is contrary to law. Hence, the present Writ Petition. The learned Assistant Government Pleader for Revenue, appearing
4. for the respondents, submits that the respondent authorities will consider and dispose of the appeal preferred by the petitioners against the order dated 03.12.2022 in RGB No. 625/2020, passed by the 5th respondent, and pass appropriate orders in accordance with law within a reasonable time. Having regard to the submissions made by the learned counsel for the petitioners and the learned Government Pleader for the respondents, and upon perusal of the material placed on record, this Court is of the considered opinion that the present Writ Petition can be disposed of by directing the respondent authorities to consider and dispose of the appeal preferred by the petitioners against the order dated 03.12.2022 in RGB No. 625/2020, and pass appropriate orders in accordance with law, after providing an opportunity of hearing to the petitioners and all concerned parties, within a period of three (3) months from the date of receipt of a copy of this Order. Till then, all parties concerned shall maintain status quo obtaining as on today, in respect of the subject property.
