B.S.Kamate, learned counsel appearing for respondents No.1 to 5. Perused the entire writ appeal papers. 2. This writ appeal under Section 4 of the Karnataka High Court Act, 1961 is directed against the order dated 03.02.2023 passed in W.P. No.100351/2021 whereunder the appellant’s writ petition praying to quash the endorsement dated 22.09.2020 is rejected. 3. In this appeal, on 15.09.2023, this Court passed a detailed interim order which reads as follows: “This intra Court appeal is directed against the impugned order dated 03.02.2023 passed in Writ Petition No.100351/2021 (S-RES), whereby the said petition filed - 3 - NC: 2025:KHC-D:6192-DB WA No.100223 of 2023 by the appellant was dismissed by the learned Single Judge. 2. A perusal of material on record will indicate that apart from rival contentions urged by both sides in the present appeal, there is also a criminal case in Special C.C.No.10/2019 pending before the Sessions Court, in which the appellant is arrayed as accused No.3. 3. Learned counsel for the appellant submits that on account of the impugned order of suspension, he is deprived of his livelihood resulting in irreparable loss and hardship and as such, the impugned order deserves to be set aside. 4. Per Contra, learned counsel for the respondents would support the impugned order and submit that there is no merit in the appeal. 5. Though several contentions have been urged by both sides in support of their respective claims, having regard to the fact that the appellant is a part-time Sweeper and has not been permitted to work or discharge his duties from 22.09.2020 onwards, coupled with the fact that aforesaid criminal case in Special C.C.No.10/2019 is still pending adjudication before the Sessions Court, by way of an interim arrangement and without prejudice the rights and contentions of the parties, we deem it just and appropriate to direct the respondents to permit the appellant to work as part-time Sweeper in the respondent-HESCOM, subject to condition that the same would be subject to final outcome of this - 4 - NC: 2025:KHC-D:6192-DB WA No.100223 of 2023 appeal as well as Special C.C.No.10/2019 pending before the Sessions Court. 6. 6. It is also made clear that this interim order is passed in the special/peculiar facts and circumstances of the instant case, since the appellant is only a part-time Sweeper and this interim order shall not be treated as precedent nor have precedential value for any purpose whatsoever. Both the learned counsel appearing for the parties submitted that in pursuance of the above communication dated 02.02.2024, appellant is working as part-time sweeper in the respondent-HESCOM. A perusal of the communication dated 02.02.2024 would indicate that continuation of the appellant/writ petitioner as Sweeper is subject to the outcome in C.C. No.10/2019 pending on the file of the District & Sessions Judge, Bagalkot. In terms of the above communication, the appellant/writ petitioner shall be continued as part-time Sweeper/Scavenger subject to the outcome of - 6 - NC: 2025:KHC-D:6192-DB WA No.100223 of 2023 C.C. No.10/2019 on the file of the Principal District & Sessions Judge, Bagalkot, and subject to the liberty to the respondents to remove the appellant/writ petitioner if there is any misconduct on the part of the appellant/writ petitioner by following the procedure prescribed in law.
