Neutral Citation No. - 2025:AHC:58336 Court No. - 4 Case :- WRIT - A No. - 5031 of 2025 Petitioner :- Pratibha Nagar Respondent :- State of U.P. and Another Counsel for Petitioner :- Hemant Sharma,Saurabh Kumar Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner wants a further period to be accorded to retain official accommodation as the petitioner has been sent to training. Learned Standing Counsel submits that petitioner earlier approached this Court when was subjected to notice vide Writ - A No. 650 of 2025 and as per the undertaking given by the petitioner she was permitted to retain the accommodation till 30.04.2025. In the circumstances, therefore, now petitioner even if has been sent for training should honor the undertaking given before this Court. Upon a pointed query being made, learned counsel for the petitioner submits that there is a Government Order already to the effect that while the Constables are sent for training they should not be forced to leave the official accommodation. In the considered view of the Court, petitioner's case is not such case which can be said to be falling under the said order. It is a case where the petitioner was to vacate the premises earlier before she was being sent for training and then she filed a petition and given an undertaking before this Court. It is in those circumstances, that both the notices to vacate the premises dated 06.12.2024 and 05.11.2024 much before she was sent for training were put in abeyance by the order of this Court on 06.02.2025. In the given facts and circumstances of the case, I decline to grant indulgence in the mater. Petition fails and is accordingly dismissed.
