... Respondent For Applicant : Mr. Sunil Sahu, Advocate. For Non-Applicant/State : Ms. Ankita Shukla, Panel Lawyer. Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 16.09.2025
1. Heard Mr. Sunil Sahu, learned counsel, appearing for the petitioner. Also heard Ms. Ankita Shukla, learned counsel appearing for the respondent/State. 2. This petition under Section 528 of the Bharatiya Nagrik Suraksha Sanhita, 2023, seeks modification of the order dated 08.09.2025 passed by this Court in MCRC No. 7095 of 2025, wherein the PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2025.09.16 18:01:04 +0530
2 father’s name, age and address of the applicant No.2, namely, Amar Singh Pardhi was inadvertently mentioned as S/o- Surajbhan, aged about – 25 years, R/o- Village – Rohansi Thana and Tahsil – Palari, District - Balodabazar-Bhatapara instead of S/o- Arjun Singh Pardhi, aged about – 28 years, R/o.- Kemtu, Mahatma Gandhi Nagar Jain Mandir, Ward No. 26 Power House Bhilai, Thana – Chhawni, District – Durg (C.G.)
3. Learned counsel for the petitioner submits that the father's name of applicant No. 2 has been incorrectly mentioned in the bail application as Kemtu, whereas it should in fact be Arjun Singh Pardhi. He further submits that in the order dated 08.09.2025 passed by this Court in MCRC No. 7095 of 2025, the father's name of applicant No. 2 has been stated as Surajbhan, whereas Surajbhan is actually the father's name of applicant No. 3. Therefore, he prays that the present petition be allowed and the said order be modified accordingly. 4.
The prayer made by the petitioner appears to be reasonable as because of the inadvertent mistake in the cause-title of the bail application, the said error has been made in the order dated 08.09.2025 passed by this Court in MCRC No. 7095 of 2025 and in the cause-title, in place of “S/o- Surajbhan, aged about – 25 years, R/o- Village – Rohansi Thana and Tahsil – Palari, District - Balodabazar-Bhatapara”, the same shall be read as “S/o- Arjun Singh Pardhi, aged about – 28 years, R/o.- Kemtu, Mahatma Gandhi Nagar Jain Mandir, Ward No. 26 Power House Bhilai, Thana – Chhawni, District – Durg (C.G.)”. 3
5. Learned State counsel has no objection to the same. 6. Learned counsel for the applicant is directed to make necessary correction in the bail application. 7. In view of the submission made by the learned counsel for the petitioner, the present CRMP is allowed. 8. A copy of this order be placed along with the records of MCRC No. 7095 of 2025. Sd/-
