S PRANATHI The Court made the following: :: ORDER :: The above writ petition is filed to declare the inaction of respondents 2 and 3 in considering the representation dated 16.01.2025, made by the petitioner regarding the unauthorized construction made by respondents 4 & 5 SRS,J W.P.No.1783 of 2025 in Sy.No.137/2 to the extent of Ac.0.05 cents or 242 square yards in Pedda Autpalli Village, Ungtur Mandal, Krishna District, is illegal and arbitrary. 2. Heard Sri K. Sai Sree Sanjay, learned counsel for the petitioner, and Sri Dheeraj, learned counsel representing Smt. Pranathi, learned Standing Counsel, appeared for respondent No.2 and Sri Y. Koteswara Rao, learned Standing Counsel, appeared for respondent No.3 and Sri G. Nageswara Rao, learned counsel, appeared for respondents 4 & 5. 3. Learned counsel for the petitioner would submit that respondents 4 & 5 are making unauthorised construction, without getting permission. Hence, the petitioner made a representation dated 16.01.2025, to respondents 2 & 3. However, no action has been taken. 4. Sri Dheeraj, learned counsel appearing for respondent No.2, would submit that a shortfall notice vide Letter No:EDS/1168/2025/0009, dated 29.01.2025, was issued to respondent No.5, pointing out certain objections. A copy of the shortfall notice was handed over to the learned counsel appearing for respondents 4 & 5 across the bar. 5. Learned counsel appearing for respondents 4 & 5 would submit that respondent No.5 will comply with the objections raised in the shortfall notice. Learned counsel also would submit that respondent No.5 made an application seeking permission on 24.01.2025. 6. Given the facts and circumstances of the case, the Writ Petition is disposed of, directing the respondents 2 & 3 to consider the representation made by the petitioner dated 16.01.2025 and pass appropriate orders, strictly as per the law. Respondent No.5 shall comply with the objections raised in the shortfall notice before proceeding further, regarding construction. If respondent No.5, submits all the relevant documents, respondent No.2 shall consider the same and pass appropriate orders, strictly as per the law, as SRS,J W.P.No.1783 of 2025 expeditiously as possible, preferably, within four (04) weeks. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
