Irfan Khan S/o Islma Khan, Aged About 24 Years, R/o Rooppura, Police Station Fuliyakalan, Distt. Bhilwara (Raj.) (Presently Confined At District Jail Ajmer (Raj.) ----Petitioners Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Ms. Vaishnavi For Respondent(s) : Mr. Jaiprakash Tiwari,P.P. HON'BLE MR. JUSTICE VINOD KUMAR BHARWANI Order 28/11/2025 The instant bail application has been filed under Section 483 B.N.S.S. on behalf of accused-petitioners in the matter arising out of F.I.R. No.202/2025 registered at Police Station Sawar, District Ajmer for the offence(s) punishable under Section(s) 8/21 of N.D.P.S. Act. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case, they have nothing to do with the alleged offence and they are behind the bars since 29.10.2025. The recovered contraband i.e. 24.45 gram (smack) is below the commercial quantity, thus, the embargo contained under Section 37 of the NDPS Act would not be [2025:RJ-JP:48374] (2 of 2) [CRLMB-14954/2025] attracted. Trial of the case is likely to take a long time to conclude, till then, his further incarceration would not serve any fruitful purpose and he is ready and willing to furnish his bail bonds. Therefore, the bail application deserves to be allowed. Learned Public Prosecutor has vehemently opposed the bail application. Heard learned counsel for the parties and perused the material made available on record. Taking into consideration the submissions put forth and overall facts & circumstances of the case but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused-petitioners on bail. Therefore, the bail application is allowed. Accused- petitioners, namely Ranjeet Kayamkhani S/o Sawaikhan Kayamkhani & Irfan Khan S/o Islma Khan, shall be released on bail, if they are not required in any other case, provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Fifty Thousand) together with two sureties in the sum of Rs.25,000/- (Twenty-five Thousand) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any other court to which the matter is transferred, on all subsequent dates of hearing and as and when they are called upon to do so.
