1. In the present writ petition, the claim of the petitioner is that the petitioner had already submitted a joint option on 27.02.2023, copy of which has been appended as Annexure P-8 but the same is not being accepted so as to grant the petitioner the benefit of higher/revised pension keeping in view the actual salary being drawn under the Employees’ Pension Scheme, 1995.

Learned counsel for the petitioner submits that the respondents be directed to take a final decision on the said joint option dated 27.02.2023 (Annexure P-8) by passing an appropriate speaking order.

Learned counsel for the respondents submits that appropriate
order on the joint option dated 27.02.2023 (Annexure P-8) submitted by the petitioner will be passed by the competent authority within a period of eight weeks of the receipt of copy of this order by passing an appropriate speaking order and in case, it is found feasible to grant the relief to the petitioner, the same will be granted otherwise due reasons will be mentioned in the speaking order to be passed for not accepting the claim of the petitioner for his information and necessary action.

Learned counsel for the petitioner submits that keeping in view the statement of learned counsel for the respondents, the present writ petition may kindly be disposed of having been not pressed any further.
