Counsel for the petitioner would submit that the petitioner was an employee of Chhattisgrh Raj Beej and Krishi Vikash Nigam Limited and he is retired from the post of Protection Assistant on 30.06.2024 but pensionary benefit has not been given to him by the respondents. 2. On the other hand, counsel for respondent No. 2 to 4 would submit that there is huge amount i.e. Rs. 89, 56,573/- for recovery against the petitioner and he has already filed WPS No. 6926 of 2018 and WPS No. 614 of 2019 before this Court wherein this Court has already been stayed recovery proceedings and he is unable to recover the said amount from the petitioner. He would further submit that so far as pension is concerned, the petitioner is governed under Employees’ Provident Fund Act, 1952 and pension is payable by EPF organization only not by the respondent/corporation and would pray for dismissal of the petition. 3. Considering the submission, the petition is disposed of directing the petitioner to make a representation before EPF organization, Raipur for pension who in-turn shall consider and decide the representation of the petitioner for grant of pension within one month from the date of receipt of the copy of the order in accordance with the law.
