This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue an appropriate Writ, order or directions more particularly one in the nature of Writ of Mandamus for the inaction of the Respondents 2 and 3 having not disposed of requisition for de-listing of property belongs to Petitioner Institution i.e.Ac.00.85 Cents in R.S.No.376/5 of Amalapuram Municipality Limits from Prohibited List published under Sec.22-A (1) (b) of Registration (Andhrapradesh Amendment) Act 1999 as notified to the office of 4THRespondent, despite lodging of appropriate application bearing No.TTAOl2500132472 dated 30.07.2025 through Mee- seva as illegal, arbitrary and against to the principles of Natrual justice and consequently direct the Respondents 2 3 to strictly adhere to the procedure established under law and to pass such other order..” 2. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. 3. The learned counsel for the petitioner submits that the petitioner submitted an application/representation dated 30.07.2025 through Mee-Seva to the respondent authorities, seeking deletion of the subject property admeasuring an extent of Ac.00.85 Cents in R.S.No.376/5 of Amalapuram Municipality Limits, from the list of prohibited properties under Section 22-A of -4- W.P. No.35857 OF 2025 Date of order:24.12.2025 the Registration Act, 1908. However, even after receipt of the said application dated 30.07.2025, the respondent authorities have neither considered the same nor issued any proceedings till date. Hence, the present writ petition. 4. On the other hand, the learned Assistant Government Pleader for Revenue appearing for the respondents submits that the respondent authorities will consider the application made by the petitioner dated 30.07.2025 and pass appropriate orders in accordance with law within a reasonable time. 5. Having regard to the submissions made by the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents, and on perusal of the material available on record, this Court is of the considered view that the present writ petition can be disposed of by directing the respondent authorities to consider the application/representation of petitioner dated 30.07.2025, for deletion of the subject property from the prohibited list notified under Section 22-A of the Registration Act, 1908 as expeditiously as possible, strictly in accordance with the law, preferably within a period of four (04) months from the date of receipt of this order. It is needless to mention that the respondent authorities shall conduct a necessary inquiry by hearing all the concerned parties. -5- W.P. No.35857 OF 2025 Date of order:24.12.2025 6.
