Neutral Citation No. - 2025:AHC:62436 Court No. - 79 Case :- CRIMINAL REVISION No. - 1697 of 2024 Revisionist :- Sovindra Singh Opposite Party :- State Of U.P. And 2 Others Counsel for Revisionist :- Raj Singh,Sunil Kumar Counsel for Opposite Party :- G.A. Hon'ble Subhash Chandra Sharma,J. Heard learned counsel for the revisionist as well as learned A.G.A. for the State and perused the record. The criminal revision has been moved with prayer to allow the revision and set aside the judgment and order dated 14.02.2024 passed by the Additional Principal Judge, Family Court (Court No.2) Bulandshahar in Criminal Misc. Case No.830/2021 (Smt Ameesha & other vs. Sovindra Singh) under Section 125 Cr.P.C., Police Station Syana, District Bulandshahar. Without going into the merit of the case, learned counsel for the revisionist submits that learned court concerned has passed the order fixing the amount of maintenance in favour of wife and minor daughter from the date of application on the place of date of order. Since the amount of arrears of maintenance from the date of application to the date of order is much more, therefore, it must be divided into easy insatallments. Learned A.G.A. has no objection in this regard. Considering the facts and circumstances of the case, submissions made by learned counsel for the revisionist as well as learned A.G.A., perusal of record and the
order passed by the learned trial court, since the prayer is only to divide the amount of arrears of maintenance from the date of application to the date of order in easy installments, therefore, the order dated 14.02.2024 does not warrant any interference on merits by this Court but it is expedient to direct the revisionist to make payment of amount of arrears of maintenance from the date of application to the date of order in 12 equal installments alongwith current amount of maintenance. Accordingly, this criminal revision is disposed of finally.
