[2025:RJ-JP:41081] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 12139/2025 Sonu Yadav Alias Mota S/o Shri Mahendra Singh, Aged About 27 Years, R/o Kaysa Thana Neemrana, District Kotputli, Behror, Rajasthan. (At Present Accused Is In Judicial Custody In Central Jail, Alwar). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Mohit Khandelwal with Mr. Aditya Gupta For Respondent(s) : Ms. Harshita Sharma Mr. Jaiprakash Tiwari, PP HON’BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 09/10/2025 1. The petitioner has filed this bail application under Section 483 of BNSS in FIR No.350/2025 registered at Police Station Neemrana, Kotputli-Behror for offence under Sections 115(2), 126(2), 189(2), 351(3), 333 and 303(2) of BNS-2023. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioner submits that due to civil dispute, the petitioner has been implicated in this case on false and concocted grounds. There is an injunction order in favour of the petitioner and the complainant forcibly tried to trespass the land of the petitioner. The specific injury caused to injured Ramswaroop was attributed to co-accused Pawan Kumar. The [2025:RJ-JP:41081] (2 of 2) [CRLMB-12139/2025] petitioner is behind the bars since 11.08.2025 without any criminal antecedents. There is cross-case of the same incident. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and the bail application of the petitioner may be allowed. 4. Learned counsel for the complainant and learned Public Prosecutor have vehemently opposed the bail application. Counsel for the complainant submits that this is a case in which right leg of the injured has been amputated and the injury was also caused to complainant’s wife and daughter-in-law, therefore, looking to the gravity and nature of offence, the petitioner is not entitled for bail. 5. On consideration of the rival submissions and material available on record and in the light of submission made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Sonu Yadav Alias Mota S/o Shri Mahendra Singh, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
