Neutral Citation No. - 2025:AHC:22564 Court No. - 10 Case :- WRIT - A No. - 33491 of 2016 Petitioner :- Pankaj Kumar Majumdar So Admin And 46 Ors. Respondent :- Union Of India And 9 Ors. Counsel for Petitioner :- Chandra Bhushan Yadav,Smt. Richa Dixita,Sudhir Dixit Counsel for Respondent :- A.S.G.I.,Ajay Kumar Rastogi,Ikram Ahmad,Pooja Agarwal,R.A. Akhtar,Vinod Kumar Shukla Hon'ble Saurabh Shyam Shamshery,J. 1. Heard Mr. Sudhir Dixit, learned counsel for petitioners, Mr. Shashank Shekhar Singh, learned counsel for respondent nos. 7 to 10 and Ms. Pooja Agarwal, learned counsel for Union of India. 2. The petitioners, who are working as Section Officers/Sr. PA at Aligarh Muslim University, have earlier approached this Court with a prayer that they may be given benefit of Sixth Pay- Commission's recommendations of pay grade of Section Officer of Central Secretariat Services. The said writ petition was disposed of with a direction to the petitioners to submit a detail representation. 3. Learned counsel for petitioners submits that a representation was submitted on 07.12.2015, which was probably received on 15.12.2015. The annexed documents therewith are not on record. He submits that claim of the petitioners was rejected by impugned order, dated 06.04.2016, on a ground that there was no historical parity between Pay-Scales of SO/Sr.PAs of Central Universities and SO of Central Secretariat Services. He further submits that in similar circumstances, in the case of SO working at Jawaharlal Lal Nehru University, a contrary decision was taken and similarly situated persons, working there were granted Pay-Scale of SO at CSC. 4. On a specific query, raised by this Court, whether said documents were annexed along with the representation, learned counsel for petitioner, on basis of records, is not able to reply. 5. In the aforesaid circumstances, since the basic document, on which the petitioners' are placing heavy reliance, was not placed before the concerned respondent, the relief sought cannot be granted, however, still considering that if the petitioners have similar case as of SO working at Jawaharlal Lal Nehru University and there is no distinguishing factor, the matter can be re-looked by concerned State respondent and for that petitioners will have liberty to approach again. 6. With aforesaid observations this petition is finally disposed of. Order Date :- 17.2.2025 Saurabh Digitally signed by :- SAURABH High Court of Judicature at Allahabad
