Application No.109/2019 filed by the petitioner before the Court of learned Additional Civil Judge and JMFC, Kathor, Surat, to the court of learned JMFC, Botad. 2) It is submitted that, the petitioner was initially resided at Surat and therefore, preferred CR.MA No.109/2019 under Section 125 of the Cr.P.C seeking maintenance in the Court of learned JMFC, Kathor, Surat. The petitioner had also filed an application under Section 12 of the Domestic Violence before the Court of ld. JMFC, Botad, in which the respondent had appeared and filed his reply. The respondent who is serving in Police Department, now been posted at Botad and present residing at Botad. Therefore, the request made by the petitioner may be allowed. 3) In view of the above, petition is allowed. Proceedings of Criminal Misc. Application No.109/2019 which is pending before the Court of learned Additional Civil Judge and JMFC, Kathor, Surat are ordered to be transferred to the court of learned JMFC, Botad. (HASMUKH D.
