Heard Sri G. Venkata Subba Raju, learned counsel for the petitioner and the learned Government Pleader for Services. 3. It cannot be denied that it is well within the domain of the employer- state to frame rules regarding recruitment process, either according to recruitment rules or even in the absence thereof, it is for the Government of the day to decide in which manner it proposes to conduct selection. Naturally, Court would be reluctant to interfere with recruitment process in the absence of apparent vitiating factors and unless the process smacks with mala itdes. 4. The petitioner seeks to homogenize the upper age limit for SC, ST, BC community people for direct recruitment of District Judges (Entry Level) prescribed in A.P. notification with that of the Telangana notification. 5. A writ petition seeking to homogenize the recruitment procedures of two States is maintainable provided the procedures are demonstrably unfair, discriminatory or violate the fundamental rights. 6. Inasmuch as the petitioner,failed to demonstrate any of the essential ingredients such as unfairness, discrimination and violation of fundamental rights, this writ petition is not maintainable and the same deserves dismissal.
