Learned counsel for the applicants is permitted to correct the description of opposite party no.2 in the array of the parties, during the course of the day. Heard learned counsel for the applicants, Mr. Rakesh Kumar Srivastava, learned counsel for opposite party no.2 as well as learned AGA for the State and perused the record. The present application under Section 482 Cr.P.C. has been filed for quashing of the entire criminal proceeding of Criminal Case No. 799 of 2015 (State vs. Manoj Arora and others) pending in the Court of Judicial Magistrate, Gautam Budh Nagar initiated in pursuance of the impugned charge-sheet dated 18.05.2015 bearing charge sheet no. 52 of 2015 submitted in case crime No. 14 of 2015, under Section 498A, 323, 504, 506 I.P.C., and section 3/4 D.P. Act at police Station Mahila Thana, District Gautam Budh Nagar on the basis of compromise entered between the parties. Vide order dated 09.07.2025, a Coordinate Bench of this Court had directed the concerned court for verifying the compromise entered between the parties and submit its report before this Court. In compliance of the said order, learned Civil Judge (J.D.)/ F.T.C.- Second/ Judicial Magistrate, Gautambudhnagar has submitted its report dated 28.07.2025 alongwith order dated 21.07.2025 vide which compromise has been verified between the parties. It has been mentioned in the said report that compromise has been reached between the parties in Case Crime No.14 of 2015, under Sections 498A, 323, 504, 506 I.P.C. and 3/4 Dowry Prohibition Act, Police Station Mahila Thana, District Gautam Budh Nagar between the complainant Smt. Neena Arora and accused applicants Manoj Arora, Smt. Usha Rani, Mukesh, Vipin Batra and Bindu Batra. It has further been disclosed that accused applicant Ramji Lal has died and proceedings against him has been abated. Learned counsel for the applicants submits that since the compromise entered between the parties has been verified by the court below, the entire proceedings of the aforesaid criminal case may be quashed by this Court. Learned counsel for opposite party no.2 and learned A.G.A. for the State also accept that the parties have entered into a compromise, they have no objection, if the proceedings in the aforesaid case are quashed. Considering the facts and circumstances of the case, as noted herein above, and also the submissions made by the counsel for the parties, the court is of the considered opinion that no useful purpose shall be served by prolonging the proceedings of the above mentioned criminal case as the parties have already settled their dispute. Accordingly, the proceedings of Case No. 799 of 2015 (New Case No.618 of 2020) (State vs. Manoj Arora and others) pending in the Court of Judicial Magistrate, Gautam Budh Nagar initiated in pursuance of the impugned charge-sheet dated 18.05.2015 bearing charge sheet no. 52 of 2015 submitted in case crime No. 14 of 2015, under Section 498A, 323, 504, 506 I.P.C., and section 3/4 D.P. Act at police Station Mahila Thana, District Gautam Budh Nagar, on the basis of compromise, are hereby quashed. The application is, accordingly, allowed. There shall be no order as to costs.
