PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A3, seeking regular bail, in crime No.310 of 2022 of Kovvur Town Police Station, East Godavari dl'strict. 2. A case has been registered against the petitioner herein and others for the offence punishable under SectI-On 8(c) read \-, he-~ 2 I/ with 20(b)(li)(C) of the Narcotic Drugs and P+sychotropic Substances Act,1985 (for short lthe NDPS Act'). 3. Case of the prosecution, in brief, is that, on 14.09.2022, on credible information, the sub-Inspector of police, Kowur, along with his staff and mediators, proceeded to Rajamahendravaram - Kovvur leading road near sir Aurthor Cotton Statue in Kovvur and, while conducting vehicle checking, found A1, A4 and A5 l'n possession and illegal transportation of 80 Kgs of Ganja in Swift Dzire Car bearing registration No.AP 27 BB 1133. The contraband along wl-th vehicle and other material was sel-zed under cover of a medI®atOrS report and a Case has been registered against the accused. The petI'tl'Oner herein/A3 Was arrested in the present crl-me on 20.12.2024. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that basing on the confessl'onal statement of co-accused, the name of the petitioner herein was shown as accused in the present crime. pu+suant to the confessional statement made by the co- accused, no incrl'minatl-ng material has been seI-Zed from the possession Of the PetitI-Oner herein. The petitioner was arrested on 20.12.2024 and since then he is in judicial remand. Learned _z=3iSi43£^ Assistant Public Prosecutor submitted that the entire investigation is complete-a and charge sheet could not be filed for want of inventory. 6. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein/A3 on the following conditions. i) The petitioner/A3 shall be released on bail on h'ls executing a personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned lI Additional Judicial Mag-lstrate of First Class, Kovvur. ii) On release, the petitioner shall appear before the Station House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and 01.00 pm, till filing of the charge sheet. 7.
