JUDGMENT:(Per Hon’ble Sri Justice Battu Devanand)
Learned counsel for the respondent/wife would submit that during the pendency of these proceedings, the respondent/wife married some other person and living with him. He further submits that both the parties have settled the matter out of the Court amicably and as such, the respondent/wife is not interested to prosecute this case.

Learned counsel for the appellant/husband also would submit that as per the instructions of his client, he is not interested to prosecute this appeal.
3. Considering the submissions of the respective counsels and taking note of the fact that the respondent/wife is already married and living separately, she is not entitled for maintenance from the appellant.
4. Accordingly, the Family Court Appeal is allowed and the decree/judgment dated 19.12.2008 in F.C.O.P.No.100 of 2008 on the file of the Family Court, Vizianagaram is set aside.
5. There shall be no order as to costs.
