Mr. Shrawan Dogra, Senior Advocate, with Mr. Rishi Tandon, Advocate, for respondents No.10 and 11. CMP No.16558 of 2026 This Court presently is having service matter roster. The present writ petition which is non-service matter has been listed before this Court on account of an application that has been filed by the applicant/petitioner i.e. CMP No.16558 of 2026, inter alia, praying for modification of order dated 27.08.2025 and to restrain respondent No.10 to do any mining activity on the area mentioned in the application in furtherance of mining lease agreement dated 18.06.2025. A perusal of the order that was passed by this Court on 27.08.2025 demonstrates that all that this Court ordered was that respondents No.10 and 11 may go ahead with the mining process, but strictly in consonance with the permission that has been granted and separate account shall be maintained by the private respondents with regard to the sale proceeds of the mining activity in the interregnum. Learned Senior Counsel for the petitioner by referring to the application has submitted that mining permission which has been granted to the private respondent is bad in law and even the activity which is being undertaken is in violation of the permission granted. This is seriously refuted by the learned Senior Counsel appearing for the respondents. Be that as it may, this Court is of the considered view that in either of the circumstances, the modification of order dated 27.08.2025 is not called for and it is in the interest of the petitioner to make an endeavour to have the petition itself decided as expeditiously as possible.
