1. This is the first bail application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of anticipatory bail to the applicant who is apprehending his arrest in connection with Crime No.286/2025 registered at Police Station Padmnabhpur, District-Durg (C.G.) under Sections 420, 467, 468, 34 of IPC.

2 furtherance of this inducement, the accused persons stated to have collected a total sum of 14,00,000/- from the complainant. To ₹
reinforce the credibility of the claim and to gain the trust of the complainant, Co-accused told the complainant that present applicant is of IAS level who has a good hold in the ministry and is the head of Vyapam and he is a committee member of CM House. Co-accused is posted on the post of babu in CHMO Durg, co-accused came to her house and showed the order letter of the post of food inspector to her and her parents and said that the work will be done 100 percent, if not, the money will be returned with interest within 15 days and for the security of which the co- accused gave her A/C. 9302103100018 48 Durg Branch Check No. 366489. Later job was not given to the complainant and co- accused abused her and subsequently FIR was lodged. Hence this offence.
3. It has been argued by learned counsel for the applicant that the applicant has been falsely implicated in this case. He further submits that there are three cases have been registered against the present applicant including the present case and present complainant was a witness in crime No.221 of 2025, which was registered at police Station Pamnabhpur District-Durg for the offence under Sections 318(4), 3(5) of BNS, 2023 on similar allegation levelled against the applicant that he had taken some money for providing job to complainant and she was a witness in the said case, and applicant has already been granted anticipatory bail by this Court in MCRCA No.1266 of 2025 vide order dated 20.08.2025 along with one Amolakshi Awasthi, who is wife of the applicant, copy of the said
order is annexed herewith at Page No.20. He also submits that applicant has also granted anticipatory bail by this Court in crime
3 No.718 of 2025 registered at Police Station – Civil Lines, Bilaspur District – Bilaspur for the offence under Sections 338 & 3(5) of BNS, 2023 in MCRCA No.1042 of 2025 vide order dated 16.08.2025, copy of the said order is annexed herewith as Annexure-A/2. He lastly submits that investigation and the conclusion of the trial is likely to take quite long time. Therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned counsel appearing for the State/non- applicant as well as learned counsel for the Objector would oppose the bail application. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant, submissions made by learned counsel for the parties and considering the fact that there are three cases have been registered against the present applicant on including the present case, out of which in two cases applicant has already been granted anticipatory bail in MCRCA No.1266 of 2025 vide order dated 20.08.2025 along with one Amolakshi Awasthi, who is wife of the applicant and in crime No.718 of 2025 registered at Police Station – Civil Lines, Bilaspur District – Bilaspur for the offence under Sections 338 & 3(5) of BNS, 2023 in MCRCA No.1042 of 2025 vide order dated 16.08.2025, therefore, this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Rajat Kumar Gupta, on executing a personal bond with one surety in the like sum to the
4 satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial.
(c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
