ORDER: This writ petition is filed under Article 226 of Constitution of India seeking following relief;
“to declare the inaction of the respondents in not passing final orders on the representation dt. 19-12-2024 for continuation of his service as NMR (Laskar) in the control of the 2"^^ respondent up to the age of 60 Years i.e., 30.06.2030, the said action of the respondents is as highly illegal, arbitrary, unreasonable, discriminatory and also in violation of principles of natural justice and also in violation of Art 14, 16 and 21 of the Constitution of India and declare the same as bad in law and consequently direct the Respondents to pass final orders on the representation dt. 19.12.2024 for continuation of his service as NMR (Laskar) in the control of the 2'^'^ respondent up to the age of 60 Years i.e., 30.06.2030 and to pass.” Heard Sri A.Venkata Ramana, learned counsel, appearing

2 CGR, J W.P. No. 10921 of 2025 Petitioner has been working as NMR in the office of 2^^ respondent. Controversy arose with respect to his age and date of birth, therefore, 2'^^ respondent has called for report from the District Medical & Health Officer, Krishna, Machilipatnam. In pursuance to the same, a report has been submitted by proceedings dated 31.08.2015 opining that petitioner was aged between 45 to 50 years as on
10.07.2015. Accordingly, the 2^^ respondent has issued Memo No.AB/A4/NMRA/ol.lV/34810,
3. dated 09.05.2016 by passing order holding tf.at the age of the petitioner would be considered as 50 years as on 10.07.2015 which is the maximum age opined by District Medical Health Officer, Krishna, Machilipatnam. Now, considering the aforesaid age, by treating petitioner to have attained age of 60 years is sought to be superannuated.

Learned counsel for petitioner submits that though opinion rendered by District Medical & Health Officer has set out the age of petitioner in the bracket 45 to 50, maximum age came to be considered, in view of the same, petitioner has submitted representation dated 19.12.2024 requesting 2'^'^ respondent to consider the lower age limit of 45 years rather than 50 years and to continue him in service till 10.07.2030, which is stated to be
3 CGR, J W.P. No. 10921 of 2025 pending. Therefore, it would be suffice to direct the 3'^'^ respondent to consider and pass appropriate orders on the aforesaid representation. Learned Assistant Government Pleader appearing for respondents submits that the petitioner is about to retire now and at this fag end, is not justified in reagitating the age, however, representation pending with the 2^^ respondent would be considered in accordance with law.

6. In view of the above, without expressing any opinion on the merits of the matter, with the consent of both counsel, this writ petition is
disposed of directing 2"^ respondent to pass appropriate orders in pursuance to petitioner’s representation dated 19.12.2024 within a period of four weeks from the date of receipt of a copy of this order strictly in accordance with law. No costs. As a sequel, interlocutory
