1. Heard Mr. Bharat Lal Sahu, learned counsel for the petitioner. Also heard Mr. Shailendra Sharma, learned Panel Lawyer, appearing for respondents No. 1 to 4/State. 2. The present petition has been filed by the petitioner with the following prayers:
“1. That, Hon’ble Court may kindly be pleased to allow the instant petition under Section 528 of BNSS, 2023 filed by the petitioner, in the interest of justice. 2. That, Hon’ble Court may kindly be pleased to quash the impugned FIR bearing No. 416 of 2024 registered on dated 13.08.2024 at Police Station Kotwali Durg, District Durg Chhattisgarh filed under Section 318(4), 336(3), 338, 340(2), 61(2) of BNS as well as further several criminal proceeding of Crime No. 416 of 2024 against the petitioner, in the interest of justice. 3. That, Hon’ble Court may kindly be pleased to direct the respondent authority to complete the investigation
3 and to produce charge-sheet before the learned competent Court and also to conclude trial proceeding at the earliest against the petitioner in the interest of justice. 4. That, the Hon’ble Court may kindly grant any other reliefs in favour of the petitioner, which the Hon’ble Court deemed fit & just in the facts and circumstances of the case, in the interest of justice.”

Upon a pointed query being put to the learned counsel for the petitioner with regard to the reliefs sought in the present petition, it is evident that, on the one hand, the petitioner has prayed for quashing of the FIR registered against him, while on the other hand, he has simultaneously prayed for completion of investigation, submission of charge-sheet before the competent Court, and conclusion of trial at the earliest. Such prayers are ex facie contradictory in nature. When confronted with this apparent inconsistency, learned counsel for the petitioner failed to offer any plausible explanation. 4. In view of the above, this Court is of the considered opinion that the reliefs prayed for in the present petition are wholly misconceived.
